Diversion (Mental Health PC 1001.35 – PC 1001.36)
Under this disposition, criminal prosecution is paused while the defendant participates in a court-approved treatment plan for a qualifying mental disorder—such as schizophrenia, PTSD, or other conditions demonstrated to have contributed to the alleged offense.
The diversion period may extend up to two years for felony charges and includes mental-health treatment and probation supervision. Entry into the program does not require a guilty plea.
This diversion is granted only after the court determines that the defendant has an eligible mental disorder, that the disorder played a significant role in the charged conduct, that the defendant is not considered an unreasonable risk to public safety, and that treatment is likely to be effective.
Upon successful completion of all ordered conditions, the case is dismissed and sealed, and the charges are treated as though they had not been filed.
